WC Act section 6 allows for regulation on exclusion of industries or number of workers New Brunswick Regulation 82-79 - Exclusion of Workers Regulation - Workers' Compensation Act limits compensation coverage to those business with three or more workers Note that employers that fall out of compulsory coverage may choose to join the workers compensation system for compensation coverage per section 4 of the WC Act.NB Regulation 82-79 identifies that in the fishing industry where a business employs 24 or fewer people is excluded from compensation coverage. Additional detail can be found in section 3.1 of Policy No. 21-010 Definition of a Worker.2.G.iv.;Heart attacks and cardiac conditions are adjudicated and managed like any other workplace injury or occupational disease. See General Regulations - Subject to Sections 3 to 18, employers and workers engaged in, about or in connection with the industries listed in Appendix  A are subject to the operation of the Act. 2.G.iii.)at the end of Appendix A (covered industries) it states& "and any occupation incidental to or immediately connected with any of the industries or operations mentioned above". However, important to note that the list of inclusdions & exclusions is not exhaustive. There is a principle-based test Bs.10(4) rebuttable presumption - Where the accident arose out of employment, unless the contrary is shown, it shall be presumed that it occurred in the course of employment, and where the accident occurred in the course of employment, unless the contrary is shown, it shall be presumed that it arose out of the employment.3.A.icThere are prescribed diseases & minimum periods under the Firefighters' Compensation Regulations. 3.B.I.primary site brain (10 years), primary site bladder (15 years), primary site kidney (20 years), primary non-hodgkins lymphoma (20yrs), lukemia (5yrs), and primary site colon cancer (20yrs).\s.35 Act - Any coal miner who has (a) has worked at the face of a mine or in similar conditions twenty years or more; and (b) suffers from a permanent impairment that is a loss of lung function, shall be compensated according to the permanent impairment as calculated pursuant to Section 34. 1994-95, c. 10, s. 35. AND s.35A presumption in relation to firefighters. s.10(3) Act Where any worker (a) was employed at or immediately before the date of injury in any process, trade or occupation prescribed by the Board by regulation; and (b) the disease contracted by the worker is set opposite to the description of the process, trade or occupation in the regulations, the disease contracted by the worker is presumed, unless the contrary is shown, to have been due to the worker's employment in that process, trade or occupation.
